Terms of Sales
These terms and conditions of sale are concluded between the Company Kourgane, whose registered office is 9 route de La Chapelle 50390 St Jacques de Néhou, registered with the trade and companies of Cherbourg under the number 509 292 579 00034 after named Kourgane and secondly, any natural person hereinafter called the Buyer wishing to make a purchase via the website www.kourgane.com hereinafter referred to as the Site.
The products offered on the Site are hand-made reproductions. The proposed photographs can not be contractual because each object is unique. Variations in size, thickness, color may be found inherent in the craft bill, and can not engage the responsibility of Kourgane. In the event that a product ordered does not suit the Buyer it is always possible to find an amicable solution by contacting Kourgane by email on the address firstname.lastname@example.org, or to use the right of withdrawal (see this chapter ).
After placing your order, filling in your details, Kourgane sends a confirmation e-mail to the Buyer and the tracking number of the package. The Buyer can nevertheless cancel his order by email at email@example.com, or by phone at +220.127.116.11.29.75 specifying his contact information and references of products purchased. In this case, Kourgane undertakes to reimburse the Buyer as soon as possible, in the event that the payment has already been cashed.
The price of the articles displayed on the Site is indicated in euros (VAT not applicable according to article 293 B of the CGI) and does not take into account the shipping costs.
Kourgane accepts payments by credit card via Paypal (with or without Paypal account), by bank transfer or by bank checks.
When paying by bank transfer or check, the order is processed upon receipt of it.
Availability and delivery times
Each item offered on the site is displayed with availability. This availability assumes that this item is in stock and guarantees the prompt delivery of this item within 15 days maximum. If, however, an item was not in stock at the time of the order, Kourgane would inform the Buyer as soon as possible. An alternative solution by another article, or the increase in delivery time would then be proposed. If none of these solutions are suitable for the Buyer, the order would be canceled.
The products are sent by french post (Colissimo recommended). Due to the fragility of the products, Kourgane makes every effort to ensure that the package is protected to avoid any breakage. If, despite everything, the product is broken, Kourgane asks the Buyer to take a photograph of the broken product and send it by email to the address firstname.lastname@example.org within 3 days of receipt. After receipt of this photograph Kourgane agrees to return the product as soon as possible by taking care of the delivery costs. If, however, the product is no longer in stock at that time, Kourgane will inform the Buyer who will have the choice between a later delivery or a refund of the item.
Right of Withdrawal
The Buyer, non-professional natural person, has a period of withdrawal of seven days from the delivery of his order to return the product to Kourgane for exchange or refund without penalty. The return costs are the responsibility of the Buyer.
Kourgane makes every effort to satisfy the Buyer and to meet these general conditions of sale. Nevertheless, the responsibility of Kourgane can not be engaged because of a fortuitous event or a case of force majeure as defined by the jurisprudence rendered by the French jurisdictions. In addition, as specified in the Products section, in case of non-substantial differences between the photos and the text of the articles and the articles ordered, Kourgane's responsibility will not be engaged.
Protection of personal data
Kourgane undertakes to protect the personal data of the Buyer collected during an order on the Site. The collected data is only used for the purpose of managing your order and solely for that purpose.
Applicable law and competent jurisdiction
These general conditions of sale are subject to French law and the Vienna Convention on Contracts for the International Sale of Goods. All disputes relating to the commercial relationship between Kourgane and the Buyer are subject to the non-exclusive jurisdiction of the French courts.
